As stated in our previous response regarding the Habitats Assessment, policy MT4 from a Habitat Regulations perspective is considered to be stronger than absolutely necessary and there are questions over how this policy could be monitored to trigger the release of land and therefore its soundness. In addition, specific restrictions regarding protection of wintering birds at Wet Moor have now been incorporated into the policy.

What changes do you suggest to make the DPD legally compliant or sound? We therefore advise as previously) that the wording "Development at Langport/Huish Episcopi will not come forward until it can be demonstrated that, in total, it will not lead to impacts on the Somerset Levels and Moors Special Protection Area/Ramsar sites" is replaced with Development in Langport / Huish Episcopi will be subject to a project level Habitats Regulations Assessment of potential impacts on the Somerset Levels and Moors Special Protection Area/ Ramsar sites.
